Drug Testing Program Policy

Drake University hereby adopts a policy for drug and alcohol education and the prevention of drug and alcohol abuse. This policy includes the testing and rehabilitation of student-athletes involved in intercollegiate athletics at Drake University. This policy is based on a presumption against the use of any artificial chemical substances that are not medically necessary (taken under orders of a physician, with notice to the athletic training staff). If an athlete has any questions about a given substance, then he/she should consult the Drug Program Administrator or other members of the training staff, and if they do not have an answer, the question will be referred to the team physician.




            1.         To insure the health and well being of the Drake University student-athlete through education, counseling and support groups to those with substance use related problems;


            2.         To insure safe, fair and equitable competition for student-athletes competing in intercollegiate athletics;


            3.         To maintain appropriate standards of behavior;


            4.         To deter substance abuse; and


            5.         To protect the integrity of the student-athlete and Drake University.


Participation and Compliance by the Student-Athlete:


1.         Annually, each student-athlete will be required to sign a Consent, Authorization and Release form to participate in the Drug and Alcohol Education and Testing Program as a condition of participation in intercollegiate athletics at Drake University.


2.         Refusal to fully participate in the Education and Testing Program and comply with all provisions set forth in this Policy Statement will result in dismissal from further athletic participation and cancellation of athletic financial aid effective immediately.  

3,         Failure to appear for a test within the allotted time period (24 hours) will be deemed a positive drug test and trigger actions outlined in “First Positive Test” below.


Drug Education/Awareness Session for Student-Athletes:


            The Drug Program Administrator and/or his/her designee will, at the beginning of each academic year, meet with each team. The Drug Program Administrator/designee will review the NCAA Testing Procedure and the Drake University Drug and Alcohol Education and Testing Program Policy Statement, including ramifications of a positive test. In addition, student-athletes, as individuals or teams, may be required to attend drug/alcohol education programs or other educational programs, as deemed appropriate by the Drug Program Administrator and the Head Coach.


Prohibited Substances:


            In an effort to be as specific as reasonably possible, the University has designated a list of prohibited substances for which it routinely tests (See Appendices A & B). The University reserves the right to add to Appendices A and B at any time with appropriate notice prior to testing for the substances added, as new information becomes available about various substances. Note: the NCAA may test for more or different substances than those routinely tested for by the University.


The Drake University Department of Intercollegiate Athletics does not condone the use of dietary supplements.  Dietary supplements do not undergo federal government approval and are not tested for quality like prescription and over-the-counter medications.  The product claims made by many dietary supplement manufacturers have not been based on scientific research in many cases.  Many dietary supplements have not been subject to research by unbiased independent researchers in order to substantiate performance claims.  The potential adverse and/or harmful effects of these substances have not been completely studied, but serious adverse effects have been reported in some instances.  As there are no federal government labeling requirements for dietary supplements, some products may contain NCAA and/or Drake University banned substances, which are not listed on the label.  It is important for student-athletes to remember that each STUDENT-ATHLETE WILL BE HELD RESPONSIBLE FOR EACH AND EVERY SUBSTANCE THAT ENTERS HIS/HER BODY. 


University Testing by Random Selection:


            Random testing will be done several times each semester during the academic year. Testing may begin on the day the student-athlete completes the consent form.


            The Drug Program Administrator will make the random selection of student-athletes from a list of eligible student-athletes on record. Selection of individuals for testing will be done either by computer program or some other method that ensures true randomness.


            The Drug Program Administrator will notify the student-athlete of his/her selection to be tested. Testing may be done at the time of the notification or at a date and time to be determined by the Drug Program Administrator, but no later than 24 hours after the notification.


            A positive test will result in imposition of sanctions and/or conditions.  See “Effect of Positive Test Results” section below. 




University Testing by Reasonable Suspicion:


            In addition to random testing, the following individuals may submit a request to the Drug Program Administrator for a student-athlete to be tested based on reasonable suspicion of improper drug or alcohol use: Head Athletic Trainer, Assistant Athletic Trainer, Strength and Conditioning Coach, Head Coach, Assistant Coach, Athletic Director, Associate Athletic Directors, Director of Compliance and Director of Academic Services.


            Objective behaviors and information that may give rise to a reasonable suspicion of improper drug or alcohol use include, but are not limited to, significant drop in academic or athletic performance, missed class time, falling asleep in class, acts of violence, significant weight gain or weight loss, abnormal or erratic conduct, agitation or anger. Reasonable suspicion may also be present where a student-athlete is involved in any incident involving illegal drugs or alcohol.


            Based upon said reasonable suspicion, the Drug Program Administrator may mandate that an individual be tested for the use of prohibited substances.  Student-athlete will be charged $50.00 for the test.


            A positive test will result in imposition of sanctions and/or conditions.  See “Effect of Positive Test Results” section below. 



Additional University Testing at the Time of NCAA Post Season Championship Qualification:


In the event that an individual or team qualifies for NCAA Post Season Championship competition, the individual or team may undergo drug testing prior to the championship event.  This test may include a more exhaustive list of substances than appears in Appendices A and B to match the NCAA banned list of drugs.  Testing will take place no more than thirty (30) days prior to the NCAA event. Unless a student-athlete qualifies for a medical exemption, he/she will be immediately banned from competing in NCAA Championship competition if he/she is found to have a positive test. Further sanctions and/or conditions may be imposed by Drake University, depending on whether this is the student-athlete's first, second or third violation. See “Effect of Positive Test Results” section below.


 Self Referral and Disclosure:


Student-athletes should feel comfortable approaching department staff about avenues for assistance.  Student-athletes will be made aware of and supported in utilizing University and community resources qualified to assist them, a teammate, significant other or family member with alcohol and drug related problems.


All student-athletes are encouraged to seek assistance for alcohol and drug problems on a voluntary basis before a violation of the department’s policy has occurred (seeking independent assistance or a rehabilitation program will not in and of itself be a cause for disciplinary action).  Student-athletes who seek help prior to notification of any drug test will receive all reasonable support and assistance appropriate to facilitate retention and academic, athletic, and social success.  The Department of Athletics does not guarantee success through its support and assistance. 


A voluntary disclosure prior to any notification of a drug test will not result in the imposition of the relative sanction listed in this Policy.  Upon a self-referral, the student-athlete’s head coach, the Drug Program Administrator and the appropriate sport program administrator will collectively determine the rehabilitative steps to be followed by the student-athlete before he/she will be allowed to return to participate in any Drake University athletic program.  In addition to the rehabilitative plan, a re-entry test will be required by the Drug Program Administrator 8-weeks post-disclosure.  A student-athlete may only self-disclose and avoid Policy sanctions once during their tenure at Drake University. Any positive drug test while receiving counseling under this self-disclosure policy will be considered a violation of this Policy and the appropriate cumulative sanction will apply.  Voluntary participation in an assistance or rehabilitation program will not prevent disciplinary action for the violation of team, department, University or NCAA rules, including those dealing with alcohol and drugs.





First Positive Test:


A.      Meet with Associate AD, Director of Compliance, Head Coach, student-athlete and Drug Program Administrator.

B.      Phone call to parents

C.      Mandatory assessment and counseling with signed disclosure allowing Drug Program Administrator to follow-up with counselor

D.      Continued drug testing at student-athlete’s expense ($50.00) for one calendar year (minimum one test/month during school year)

E.      Head Coach will consult with Associate AD prior to invoking a harsher penalty.

F.      Medical clearance from team physician prior to return to athletics following assessment.

G.     Positive test result provided to Drake University Dean of Students.


Second Positive Test:                                                                                                                         


A.       Meet with Associate AD, Director of Compliance, Head Coach, student-athlete and Drug    Program Administrator.

B.       Phone call to parents.

C.       Loss of 50% of participation in NCAA countable contests in all sports from date of positive test.  If 50% of annual countable contests cannot occur in academic year, suspension will carry over to the next year.

D.       Mandatory assessment and counseling.

E.       Continued drug testing at student-athlete’s expense ($50.00) for rest of athletic career (minimum one test/month during the school year).

F.       Athletic Financial Aid may be revoked.

G.       Athlete cannot use loss of participation as a red-shirt year

H.       Medical clearance from team physician prior to return to athletics participation following assessment

I.         Positive test result provided to Drake University Dean of Students


Third Positive Test:


A.      Meet with Associate AD, Director of Compliance, Head Coach, athlete and Drug Program Administrator.

B.      Cancellation of athletic financial aid effective immediately.

C.      Dismissal from intercollegiate athletic participation at Drake University.

D.      Positive test result provided to Drake University Dean of Students.




            Every student-athlete has the right to appeal (1) the results of the drug test, and (2) the sanctions/conditions imposed.


            All appeals must be in writing and delivered to the Associate Athletic Director within ten (10) days after the notification to the student of a positive test or notification to the student-athlete of the sanctions and conditions imposed, whichever is later.  Student-athlete will be responsible for imposed sanctions during appeal.


            An Appeals Committee consisting of the Drug Program Administrator, the Team Physician, the student-athlete's Head Coach, the Associate Athletic Director that oversees the student-athlete's sport, and Director of Compliance will hear the appeal within ten (10) business days of receiving the written appeal.  The student and the University may bring relevant witnesses and documents to the hearing.  The Drug Program Administrator will facilitate the hearing and will decide all questions relating to witnesses, documents and logistics of the hearing.    The student may have an advisor present, but the advisor shall not address the Appeals Committee.  If the student chooses to not attend the hearing or provide witnesses and documents, the Appeals Committee will proceed to decide the appeal based on the information available.  The Appeals Committee will make a recommendation to the Athletic Director. The Athletic Director will then rule on the appeal.


            The Athletic Director's decision is final.


Additional Sanctions or Conditions:


            This Policy Statement does not limit the authority and discretion vested in the various University departments and recognized organizations (including the Office of Student Life, residence hall and dining hall staff, Greek student leaders and staff and student organizations and staff) to investigate and sanction student-athletes within their jurisdictions in accordance with their rules, regulations and policies.


Not a Contract:


            This Drug and Alcohol Education and Testing Program Policy Statement does not constitute a contract between Drake University and its student-athletes. The University reserves the right to modify these procedures without notice.
